8. Face Recognition Terms and Conditions
8.1 Data Controller and Owner
WAKI app collects your photo to use face recognition to enable secure identity verification and personalized wallet features. This data is stored securely on our servers and is not shared with third parties.
8.2 Types of Data Collected
Among the types of Personal Data that this Application collects, by itself or through third parties, there are: Camera permission.
Complete details on each type of Personal Data collected are provided in the dedicated sections of this privacy policy or by specific explanation texts displayed prior to the Data collection. The Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this Application. All Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services. In cases where this Application specifically states that some Data is not mandatory, Users are free not to communicate this Data without any consequences on the availability or the functioning of the service. Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner. Any use of Cookies – or of other tracking tools – by this Application or by the owners of third-party services used by this Application serves the purpose of providing the service required by the User, in addition to any other purposes described in the present document and in the Cookie Policy, if available.

Methods of processing. The Data Controller processes the Data of Users in a proper manner and shall take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. Depending on the User's specific device, this Application may request certain permissions that allow it to access the User's device Data as described below.
By default, these permissions must be granted by the User before the respective information can be accessed. Once the permission has been given, it can be revoked by the User at any time. In order to revoke these permissions, Users may refer to the device settings or contact the Owner for support at the contact details provided in the present document.
The exact procedure for controlling app permissions may be dependent on the User's device and software.
If User grants any of the permissions listed below, the respective Personal Data may be processed (i.e. accessed to, modified or removed) by this Application.
Camera permission. Used for accessing the camera or capturing images and video from the device.
8.6 Detailed Information on the Processing of Personal Data
Personal Data is only used for demonstrating the facial recognition capabilities in the WAKI application and it is not stored nor distributed outside of the application.
8.7 Additional Information About Data Collection and Processing
Legal action. The User's Personal Data may be used for legal purposes by the Data Controller, in Court or in the stages leading to possible legal action arising from improper use of this Application or the related services. The User declares to be aware that the Data Controller may be required to reveal personal data upon request of public authorities.
Additional information about User's Personal Data. In addition to the information contained in this privacy policy, this Application may provide the User with additional and contextual information concerning particular services or the collection and processing of Personal Data upon request.
System logs and maintenance. For operation and maintenance purposes, this Application and any third-party services may collect files that record interaction with this Application (System logs) or use for this purpose other Personal Data (such as IP Address).

8.8 The Rights of Users

This Application does not support "Do Not Track" requests.

These terms of use (the "Terms") govern the use of images (the "Images") for face recognition purposes provided by WAKI ("Company").
9.1 Use of Images
Company grants to the user ("User") a non-exclusive, non-transferable license to use the Images solely for the purpose of face recognition.
9.2 Ownership and Copyright
The Images are owned by Company or its licensors and are protected by copyright laws and other intellectual property laws. All rights not expressly granted herein are reserved by Company.
9.3 Encryption and Protection
Company will encrypt the Images and implement reasonable security measures to protect the Images from unauthorized access, use, or disclosure.
9.4 Use Restrictions
User may not use the Images for any purpose other than face recognition. User may not sublicense, sell, rent, lease, or otherwise transfer the Images to any third party. User may not use the Images in any way that could be considered defamatory, obscene, or illegal.
9.5 Warranty and Disclaimer
Company warrants that it has the right to grant the license granted herein. Company makes no other warranties, express or implied, regarding the Images, including without limitation, any implied warranties of merchantability or fitness for a particular purpose.
9.6 Limitation of Liability
In no event shall Company be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Images.
9.7 Indemnification
User agrees to indemnify, defend, and hold harmless Company, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with User's use of the Images.
9.8 Termination
Company may terminate this license at any time upon any breach of the terms and conditions of this license by User. Upon termination, User must immediately cease using the Images and destroy all copies of the Images.
9.9 Governing Law
This license will be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without giving effect to any principles of conflicts of law.
9.10 Entire Agreement
These Terms constitute the entire agreement between the parties and supersedes all prior and contemporaneous agreements, representations, and understandings, whether written or oral.

10. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any disputes shall be subject to the exclusive jurisdiction of the Saudi courts.
